Kid Icarus prominently features public domain characters and said characters (namely Hades and Medusa) appear as trophies in Smash 3DS, so the main point isn't even true in the slightest. Odin I'm a bit iffy on; on one hand, he is directly responsible for what happens on the Midgar stage whenever he's summoned; on the other, only his slash is interactable and he's a background PNG otherwise (with the Alucard assist trophy and Dracula boss, you can at least beat them up until they die).
